The policy is given only for the websites related to http://www.joyflo.com; third websites accessed by the user through links are not covered by this policy.

 

DATA CONTROLLER

The Data Controller for this website is JOYFLO SRL , based in Italy, in Via Pravato, 50, Paese (TV).

The Data Controller decides autonomously the purposes of the data processing, the measures and the procedures in order to grant the confidentiality, integrity and availability of such data.

 

PURPOSES OF DATA PROCESSING

The purposes of data processing are summarised as follows:

1. Registration on the website and use of the services offered by JOYFLO SRL;
2. preparation of offers and execution of the resulting contracts
3. To send CVs;
4. forwarding of newsletters for purposes of marketing, advertising, promotional activities, detection and evaluation of the customer satisfaction, included the sending of sales materials related to services and marketed products, both transmitted electronically (e-mail, SMS) and conventionally (by paper mail, by phone).

We remind you that, as provided for by art. 130, paragraph 4, Italian Legislative Decree no. 196/2003, the Data Controller will manage the data to send you advertising e-mail regarding products and services similar to those already used by the user, unless there is an express refusal of such purpose (“soft spam”).

 

PROCESSING ARRANGEMENTS AND DATA RETENTION PERIOD

The personal data will be processed mainly electronically, with the aim of ensuring the confidentiality, the logical and physical security of the personal data.

The data acquired will be retained only for the time needed to achieve the purposes for which they were collected, namely:

1. data of the registered user: until the user will ask their cancellation;
2. data related to the preparation of offers: until the expiry date indicated in the offer. In case of acceptance, the data will be kept for the time indicated as specified, or for the duration of the contract and for 10 years after the conclusion of the contract;
3. C.V. data: 12 months;
4. data collected for sending the newsletters, also for marketing purposes: up to the exercise of the right of opposition and in ny case for 2 years from the last interaction of the interested party.

 

Lawfulness of processing and MANDATORY OR OPTIONAL DATA PROVISION

The provision of personal data to JOYFLO SRL  can be mandatory or optional.

In case of mandatory data provision, the absence of their statements involves the impossibility for JOYFLO SRL  to fulfil the requirements.

The legal basis of the processing:

• for the purposes identified in points 1) and 4) is the consent given; in case of its absence the sending of newsletter and advertising material will not take place. 
• the execution of pre-contractual measures and the execution of the contract (Article 6 paragraph 1, letter b)), with reference to the preparation of offers and the consequent contracts;
• for the purpose identified in point 3) is the consent given at the bottom at the CV.
• for the purposes identified in points 4) is the consent given; in case of its absence the sending of newsletter and advertising material will not take place. 

For completeness, it should be recalled that in some cases (not related to the ordinary management of the website) the Supervisory Authority may request information pursuant to Art. 157 of the Italian Legislative Decree no. 196/2003, in order to control and supervise the data processing. In this case, the reply is mandatory and it is punishable by the administrative law.

 

DATA DISSEMINATION

The collected data could be communicated to the following subjects:

• those who/which have the right to access to these data in compliance with legal provisions;
• our contractors and/or employees within the scope of their respective responsibilities and under specific instructions to process your data; 
• third parties, properly selected, experienced, capable and reliable, who/which offer appropriate guarantees regarding the application of the provision on data protection, including data security requirements. Such subjects are appointed as “Data Processor” and carry out their activity under the instructions and the authorisations given by JOYFLO SRL.

 

NATURE OF DATA PROCESSING

Web browsing data

Web browsing data are not collected to be associated with individual users, but, by their nature, they could allow the identification of the users through processing and in combination with third parties data.

IP addresses fall under this category, as well as domain names related to the computers used by users to access the website, including further parameters related to the operating system and the technical environment of the user.

Such data are used only to obtain anonymous statistical information on the website’s browsing, or to monitor its proper functioning; therefore, they will be cancelled immediately after the elaboration.

Common data

Necessary common data would be necessary to enter or process the purchase order, as well as to benefit from the services offered by JOYFLO SRL.

The optional or voluntary sending of e-mail to the addresses identified on this website implies the recording of the e-mail address of the sender, which is necessary to reply to the requests.
